You should carefully read the following Terms and Conditions. Your
purchase or use of our products or services implies that you have read
and accepted these Terms and Conditions.
License
JoomlaWorks grants you non-exclusive limited license to use
the extensions and other products sold through our web site (the
"products") in accordance with these Terms and Conditions (the
"license").
Limited Use Granted
You may use each individual product on a maximum of five (5) websites only, belonging to either you or your client. You have to
purchase the same extension again in order to use it for more than 5
websites.
Modifications
You are authorized to make any necessary modification(s) to our
products to fit your purposes. You may not however redistribute or
release any modifications as GPL or otherwise. You must also not change
or remove the copyright information in the XML descriptor or
HTML/CSS/Javascript/PHP files, as well as the product version inside
HTML comments on PHP files. Porting our products to other platforms and
content management systems and redistributing as GPL or otherwise is
also strictly prohibited. Please contact us if you have any
requirements that are not covered by these terms.
Unauthorized Use
You may not place any of our products, modified or unmodified, on a
diskette, CD, website or any other medium and offer them for
redistribution or resale of any kind without prior written consent from JoomlaWorks.
Updates
All updates for the same product series are free to all valid
customers. For example, if you purchase version 1.2 of one of our
products, you are entitled to free updates on all 1.x product version,
but not on 2.x, 3.x and so on. Please also note that our products are
always developed for the latest stable versions of Joomla! and Mambo.
If there are any exceptions, we will always make sure to clearly state
so in our product descriptions. When a new version of one of our
products is released, it is published in our Product Download Systems
(or PDS for short). Just login
or follow the password reminder procedure
using your Paypal-connected email address if it's the first time you're using the system.
File Delivery
The payment process is fully automated. After you purchase a product
through Paypal, click on the "complete purchase" link to instantly
download the product. You will also receive an email containing
download instructions and other important info, to the email address
you used with Paypal to complete your purchase. If you choose to pay
with an "eCheck", please note that the delivery is not instant. This
process takes 3-8 business days to clear. Once the payment is cleared,
an email is automatically sent to your Paypal-connected email address
with download instructions.
Assignability
You may not sub-license, assign, or transfer this license to anyone else without prior written consent from JoomlaWorks.
Ownership
You may not claim intellectual or exclusive ownership to any of our
products, modified or unmodified. All products are property of JoomlaWorks.
Our products are provided "as is" without warranty of any kind, either
expressed or implied. In no event shall our juridical person be liable
for any damages including, but not limited to, direct, indirect,
special, incidental or consequential damages or other losses arising
out of the use of or inability to use our products.
Use of Content
You acknowledge that all JoomlaWorks sites contain or may
contain material (collectively the "Content") which is protected by
copyright, trademark or other proprietary rights. You may not transfer
or sell, reproduce, create derivative works from, distribute, or in any
way exploit any of the Content, in whole or in part, except with an
expressly permitted agreement from JoomlaWorks or their respective creators.
Return/Refund Policy
Since our company is offering non-tangible irrevocable goods we do
not issue refunds after the product is shipped, which you are
responsible for understanding upon purchasing. Please make sure that
you've carefully read all relevant documentation and tried out the
demos.
Support
JoomlaWorks offers commercial extensions "as is", with no
implied meaning that they will function exactly as you wish or with all
3rd party extensions. Further, we offer no support via email or
otherwise for installation, customization, administration of
Joomla!/Mambo etc. The official customer-to-customer Support Forum is available to everyone seeking for help. However JoomlaWorks commits to monitor the forum, providing additional assistance and guidance.
Warranty
JoomlaWorks does not warranty or guarantee these products in
any manner. We cannot guarantee they will function with all 3rd party
extensions or templates as there is currently no certification process
for such extensions or templates. All JoomlaWorks products are
tested to work on all major browsers, including Mozilla Firefox (and
all Gecko based browsers, e.g. Flock), Microsoft Internet Explorer (and
all Trident based browsers, version 6 and newer), Opera, Apple Safari
(version 3 and newer, as well as all WebKit based browsers).
Controlling Law and Jurisdiction
THIS LICENSE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH
THE LAWS OF COURTS IN PRAGUE, CZECH REBUBLIC, WITHOUT REGARD TO CONFLICTS OF
LAWS PROVISIONS. YOU HEREBY AGREE AND CONSENT THAT THE SOLE AND
EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR
RELATING TO THIS LICENSE SHALL BE A COURT LOCATED IN PRAGUE, CZECH REBUBLIC.
JoomlaWorks reserves the right to change or modify current Terms and Conditions with no prior notice.
